All you can fly Wizz air, the company changes (for the worse) the conditions just days before start-up. Here's how to get your money back

In recent hours a couple of readers, who have bought Wizzair's All You Can Fly season tickets., they wrote to point me to an email in which they the company reports the change in the terms and conditions of the contract.

In these cases, the regulations provide that consumers, that is, those who purchased the pass, have the option to withdraw from the contract.
Unilateral contract changes, timelines for withdrawal
We would like to thank you again for joining All You Can Fly! As part of your membership, you will receive emails from us from time to time regarding updates to the terms and conditions applicable to your All You Can Fly membership. Our goal is to provide transparency and give you an opportunity to review these changes before they go into effect.
So begins the email received by travelers (obviously not in Italian) in which the company announces the first changes with 3 days to go before bookings begin.
Please note that if you do not respond to these changes by September 25, 2024, you will be deemed to have accepted these changes and no action will be required of you. This means that if you want to get a full refund of the amounts paid, it is required to fill out the appropriate form by that date.
Amounts will be credited within 72h to the same payment method used at the time of subscription purchase.
The "pejorative" changes are hidden
Singular the company's "transparency" which hides the changes in the email in perfect legalese, not to mention that the T&Cs are only available in English. In fact, the important changes are at the end of the email, while the initial part talks about the change in the timing of withdrawal from automatic renewal for residents of Israel!!!
No guaranteed places, not all vacancies will be available
The crux of all discussions since the company launched this pass revolve around the actual availability of places which, starting 72h after takeoff, will be available to be booked by All you can fly pass holders.
The first major changes were made to Section 6.2 of the contract conditions.
Wizz Air does not guarantee that you will be eligible to book flights and/or seats available with Wizz All You Can Fly because the availability of airline tickets and seats is subject to certain commercial and algorithmic limitations and restrictions (e.g. non-exhaustive example)
- Total number of members registered in Wizz All You Can Fly that fall within the given flight;
- total number of passengers who have already booked airline tickets on indicated flight at the time you try to book an airline ticket with Wizz All You Can Fly;
- Number of seats available* when you try to book an airline ticket with Wizz All You Can Fly
- Total seat capacity of the flight in question.
*Seat availability is not guaranteed. The number of seats available to Wizz All You Can Fly members may differ from those available through regular booking. Wizz Air can decide how many tickets to offer to All You Can Fly members for each flight and can add or remove tickets at any time
With this clarification Wizzair introduces, at its discretion, the possibility of limiting available seats On every flight. Variables completely out of the passenger's control. Especially wants to say that an All You Can fly user might not see seats available on a flight, while the same flight might have seats regularly on free sale.
At the second no-show the subscription is cancelled
When I say that the communication sent by Wizzair is decidedly opaque, I am referring specifically to this passage.
We reduced from three to two the number of possible failed attempts not to take flight (section 8.5).
To understand what he means by "Fehlversuche" since the email received from our readers (Italians who chose an Italian airport as their airport of choice) is in German you have to open the T&Cs where in English it reads:
If the suspension of Your Wizz All You Can Fly membership stems from breaching the provisions set out in Point 6.6 in two (2) instances per Eligible Period and You did not remedy the reasons for suspension in accordance with Point 8.3, Wizz Air may immediately terminate Your Wizz All You Can Fly membership without refunding the Voucher Fee andmay impose a contractual penalty on You, which may be up to the amount of the Voucher Fee.

Other readers after receiving the email in non-Italian language received a second email in their native language
Here's where the "failed attempts" become. breaching the provisions set out in Point 6.6 in two (2) instances per Eligible Period. So to understand what is meant by the two "breaches" we need to go back to Section 6.6 of the contract, which reads as follows:
You should only book flights that You intend to board. You should not repeatedly and fraudulently book flights that overlap each other, that are duplicate itineraries, or that are impossible to fly due to the foreseeable delay or cancellation of the flight in an abusive manner. Further, You should check in and show up to flights that You book and should not fail to repeatedly show up for flights which You book. By the same token, You cannot book multiple flights to the same airport or for the same departure time on the day You selected (see Point 8.5 for the consequences for breaching this Point).
In a nutshell. 3 no-shows were allowed in the previous version Before the subscription was cancelled, there are now only 2 flights booked that you will be able to miss before you see your pass canceled.
Why it is important to read the T&Cs WELL
I said it clearly and immediately Before buying you should read the terms of the contract well, e now that they are being tightened further, it is even more important to assess the possible way out resulting in reimbursement of the full amount spent.
A splendid marketing operation that could turn into a boomerang for the company, however, because in 72h will begin the hunt for 9.99 tickets by those who bought the pass and may not even be the worst situation if, as it seems, more subscribers will be arriving soon to hunt for the same seats.
In conclusion
Clarification on vacancies is a real "cold shower" for pass holders, puts in black and white that not all vacancies will be made available to owners and the reasons will be absolutely "uncontrollable" by the user. A real pass for the company to avoid any discussion and have total discretion.
More correct, though blameworthy, is the choice to reduce possible no-shows. Without a penalty, people would be booking seats at random, even for fun. Of course considering that reservations are not cancelable, once confirmed, two no-shows alone are very few.
I am increasingly convinced that perhaps, 1 out of every 1,000 travelers who bought this pass at the end of the year will be able to say that they made a profit on it.o, everyone else at best will have spent much more to make (perhaps) the same trips and only aboard Wizz.
